1. Introduction
Welcome to BridgePointCrest ("we," "our," or "us"). These Terms & Conditions ("Terms") are applicable to your utilization of our yacht charter services and our website at bridgepointcrest.sbs (the "Service"), which is managed by BridgePointCrest.
By securing a charter or using our Service, you consent to these Terms. Should you reject any section of the terms, you are not permitted to use the Service.
2. Service Overview
BridgePointCrest offers a variety of superior yacht charter services, including:
- Daylong yacht hires
- Evening boat tours
- Business retreats
- Exclusive gatherings
- Extended charters
These services are available based on both availability and meteorological conditions. We maintain the right to change or halt services at any given time.
3. Booking and Reservations
3.1 Booking Process
To arrange a charter, you need to:
- Have a minimum age of 18 years
- Submit precise and updated information
- Make a deposit as detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is only considered confirmed after we have received your payment and provided you with written confirmation. We retain the discretion to deny services to any individual.
3.3 Availability
Charter availability is contingent on both vessel availability and favorable weather conditions. We will strive to fulfill your requested dates and timings as reasonably possible.
4. Payment Terms
4.1 Pricing
All prices are presented in € and incorporate any relevant taxes, unless stated differently. Prices may be subject to modifications without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter fee is due when booking
- Final Payment: Expected 48 hours before the charter departure
- Incidental charges (if any): Payable at the closure of the charter
4.3 Payment Methods
Payment options include major credit cards, electronic bank transfers, and certified bank cheques. All payment processing is conducted through secured, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Full refund minus transaction fees
- Cancellations made between 24-72 hours before departure: 50% of the amount will be refunded
- Cancellations made less than 24 hours before departure: No refund is issued
5.2 Weather Cancellations
When weather conditions are considered hazardous by our captain, we will propose to:
- Reschedule your charter to an alternative date at no extra fee
- Issue a full refund if no alternative scheduling fits
5.3 Mechanical Faults
Should there be mechanical issues with the vessel designated for your trip, we will endeavor to offer a comparable replacement. In the absence of an alternative, a full refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions given by the boat's crew
- Wear any safety equipment provided when necessary
- Declare any medical issues that may influence their safety
- Stay within the specified areas of the yacht
6.2 Prohibited Items
The following items are prohibited on board:
- Glass receptacles
- Illegal materials
- Weapons or firearms
- Excessive beverages (beyond moderate consumption)
- Pets (unless given prior authorization)
6.3 Conduct
Travelers are expected to behave in a manner that is courteous and respectful. We reserve the option to discontinue a charter without a refund if the behavior of any passenger endangers others or disrupts the experience for other patrons.
7. Liability and Insurance
7.1 Our Liability
We limit our accountability to the cost incurred for your charter. We are not liable for:
- Injuries resulting from the negligence of guests
- The loss or damage of personal items
- Impacts that are indirect, resulting, or punitive
- Delays due to weather conditions or other factors beyond our control
7.2 Insurance
Comprehensive marine insurance is in place that covers our fleet and operations. Clients are advised to have their individual travel and personal insurance.
7.3 Risk Acceptance
Engagement in our charter services signifies that you recognize inherent risks with marine activities and that you assume responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules can be modified subject to considerations like weather, safety, or operational needs. Every effort will be made to offer an experience of comparable quality.
9. Force Majeure
Instances that fall outside our authority, such as severe weather events, acts of nature, government actions, port closures, and mechanical failures, do not make us liable for any resulting delays, cancellations, or alterations.
10. Privacy and Data Security
Personal information is processed in line with our Privacy Policy. When you avail of our services, you consent to the gathering and usage of your data as outlined in our Privacy Policy.
11. Intellectual Property Rights
Content on our website, such as text, visuals, trademarks, logos, and imagery is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is not permitted without our explicit written consent.
12. Applicable Law
Law from the jurisdiction of Monaco governs these Terms. Disputes, if any arise, are to be resolved in the courts located in Monaco, Monaco.
13. Revisions to Terms
At any point, we reserve the right to modify these Terms. Changes will be posted on the website with the date of revision updated. Your continued use after changes indicates acceptance of the new terms.
